FBI Bases Iowa ALF Case on Facebook, Speaking Event, YouTube

university of iowa alf affidavit An FBI affidavit has just been released in the investigation of the 2004 Animal Liberation Front break-in at the University of Iowa. It shows the stream-of-consciousness approach the FBI’s Joint Terrorism Task Force took to the investigation, including surfing MySpace and Facebook and using an informant to identify activists on YouTube.

The affidavit from October, 2009, also shows the shaky pretext used to justify charging Scott DeMuth with Animal Enterprise Terrorism, jailing Carrie Feldman in a grand jury witch hunt, and raiding the home of Peter Young.

For example:

  • A confidential informant was used to identify individuals in a YouTube spoof video created prior to the Republican National Convention in the Twin Cities. The video, like many others that have been made for mass protests, shows faux “Black Bloc” activists getting ready for the RNC. (The joke is that they are sipping coffee and reading the newspaper while wearing black masks.) The informant reportedly identified Carrie Feldman and Scott DeMuth as cast members in the skit.

    When the video came out, I posted about it on this site, and jokingly called it a “Homegrown Terrorist” training video. Months later, the government is calling it exactly that.

  • The government says Scott DeMuth wrote in his diary about the ongoing political crackdown on environmental activists. For example, one alleged entry includes, “Fuck the Feds” and “Turns out the Feds have shit on P” (who the government claims is Peter Young). DeMuth also allegedly wrote “It’s almost been a year since Iowa,” which the FBI agents typed in bold font, implying that DeMuth must have been involved in the ALF raid.

    DeMuth allegedly wrote, “And the ABC [Anarchist Black Cross, a group that supports political prisoners] has gotten a fair amount of attention from the FBI. I don’t think I am at too much risk.”

  • DeMuth’s Facebook, Livejournal and Myspace all “identify him with his interests of animal rights, anarchy and ecological extremist groups,” the FBI says.
  • An FBI agent reviewed a MySpace photo of Carrie Feldman, posing with a white rat on her shoulder. Rats were removed during the Animal Liberation Front raid at the University of Iowa.
  • Activists organized a Dangerous Media Tour, also known as “The Steal This Film Fest.” This public event, open to everyone (including the FBI, who were there taking photos) included information on making free phone calls and other hacks to resist “corporate rule.” The affidavit paints this is a covert terrorist gathering, but to anyone familiar with CrimethInc., Evasion, and the like, there is an entire punk subculture built up around similar petty scams.

I spoke with Lauren Regan of the Civil Liberties Defense Center to help me put this affidavit in context. “This is just an incredible example of how extremely flimsy the actual fact evidence is in these cases,” she said. “If they had stronger evidence against this kid [DeMuth], they would have used it.”

It doesn’t seem that the government has anything else to go on. When prosecutors filed an emergency motion to keep DeMuth locked up, they based it on labeling him an anarchist.

This is an important point to underscore. The date of this affidavit, October, 2009, places it before the Utah raid of Peter Young’s home, and before the grand jury. In other words, it is very likely that the entire case for the indictment of Scott DeMuth was based on this flimsy string of information, including lawful speaking events, Facebook, and YouTube.

    Looking into the journal entry (dated to August of 2005) stating, “it has been a year since Iowa.” The date seems to correspond more to the arrests of individuals at the Crimethinc Convergence in Des Moines, Iowa in August 2004. The convergence experienced “constant police and FBI harassment and intimidation.” Individuals were arrested, and items seized, “including lamp oil that was to be used for a fire-breathing skillshare and PVC pipe that was to be used in a home-made didgeridoo workshop.” The police issued a statement saying they had “evidence” of “terrorist” activities. http://www.crimethinc.com/texts/pastfeatures/co...

    The comment about the ABC makes sense given DeMuth's involvement in ABC at the time and the attention directed at it by the Director of the FBI Robert Mueller in February of 2005:

    The potential for violence by anarchists and other emerging revolutionary groups, such as the Anarchist Black Cross Federation (ABCF), will continue to be an issue for law enforcement.     The journal seems to speak more to the paranoia surrounding the ongoing “terrorization” of dissent (even pre-Green Scare indictments) than to any actual “terrorism”.

    The “RNC 8″ will be back in Ramsey County district court (St. Paul, Minnesota) on May 3-6 and 13-14 for hearings on defense motions, including a motion to suppress evidence seized in the SWAT team raids of three south Minneapolis homes on Aug. 30, 2008, the weekend before the Republican National Convention began in St. Paul.

    According to the affidavit from the Iowa Joint Terrorism Task Force, Scott DeMuth was living in the house at 2301 23rd Ave. So., which was raided by one of the heavily armed SWAT teams (comprised of Minneapolis cops, Ramsey County sheriff's deputies and FBI agents. These raids were based on hyped-up allegations, mainly reported by paid police informants, which led to eight local organizers, the RNC 8, being arrested and charged with “conspiracy to riot in furtherance of terrorism.”

    In April 2009, the “terrorism” charges were dropped, because the Ramsey County attorney acknowledged that they would be a “distraction” at trial. The RNC 8 defendants each still face two felony conspiracy charges.

    The RNC 8 Defense Committee is working to mobilize support for the upcoming hearings in May, for a trial that has been scheduled for Oct. 25, and in defense of Scott DeMuth, who has been snared in the dangerous, ongoing government efforts to criminalize dissent.

    Do not hate the FBI too much, during 2004-05 they were under control by the Bush 2 administration, and it is somewhat clear that the agenda of Bush 2 and his staff set was in favor of certain interests over other interests.

    This is the ugly and the beauty of our system. One man and his staff can run an office how they want, but when they are voted out and replaced, that office can change. And our current day, has obviously put a value on ones skin color which hopefully will not blind too many people.

    What a crock of shit. Reading that affidavit is like reading an 8th grade book report. No cohesive point. They jump from talking about a hard drive taken without mentioning anything on it to making an assumption that two people who bought some overalls and some tools were involved and no doing, oh I don't know, construction on their house. They even admit to how weak the evidence is.

    I particularly enjoyed how we are supposed to believe that a highway cop vividly remembers pulling over two people for speeding (a traffic citation which had nothing to do with any of this, other than as an excuse to include names in the affidavit) from YEARS ago.

    Well look when this incident occurred…2004-05? Who was president. But I guess you know it all, so there is no point saying anything. Read it all and think before you respond.

    My point is that maybe ALF was targeted a lot easier since everything that was going on in our nation and the recnt gain of power from the war on terror.

    Some people forget to associate the actual time in history and what was going on with what they are talking about.

    Maybe you should do a little research into the FBI. I am a senior in Political Science, and I do not just pull comments out my ass and take what I hear from people with no knpowledge and turn it into truth. Just because you think you know it all, more likely means you don't know too much, or you cannot think about too much.

    And Obama has NOTHING to do with something that occurred 5 years back…but then again I am sure you were against 'obamacare' or whatever the funk it is…

    These targeted prosecutions and political witch hunts have been going on throughout all of American history. Only the names have changed (anarchist, communist, terrorist, etc). That's kind of the whole point of this blog. It has nothing to do with which half of the oligarchy is in power at the time. Take your own advice and do a little research next time before you make a fuss and embarass yourself.
