When I first read your article, was inclined to agree and to some degree, I would say that the process itself (which is already in place and will not be altered by the Senators bill) seems unconstitutional. However, the bill is only adding criteria that defines treacherous activity, specifically aiding foreign terrorist organizations against the US and its allies. The actual process of appearing before the State Department is in place already and has been for quite some time. Lastly, if a person wanted to appeal the State Departments decision, they could take it to the federal courts. Good article Will, very thought provoking, thank you.

Sean: Yes, I've read it, and to be clear I am not saying that domestic activists or organizations would be targeted by this bill. I was simply saying that this needs to be put in a larger political context, in which a variety of efforts are being made that are unconstitutional and overly broad.

Read the bill, http://lieberman.senate.gov/assets/pdf/TEA_full... on Senator Lieberman's website. It's a short and easy read. It speaks directly to support of foreign terrorist organizations and to those supporting hostilities against the US and those engaged in hostilities that the US is engaged in (along side us). In fact, this expands upon USC Title 8, 1481 which already outlines how naturalized or native-borne citizens can lose/voluntarily renounce their citizenship, so that it is more pointed to target those who would support an enemy that would kill you and I. It seems fine to me. It would seem that people who set fire to lambskin outlets and commit other acts of felonious "domestic eco/animal enterprise terrorism," need not worry about this bill depriving them of their citizenship...unless, of course, they are looking to support or aid our enemies. I would be worried about losing certain civil rights though, as this is a possibility for some felonies.

Hi Tracy,
No, neither are on the 2010 list.

The State Dept list is described as solely for foreign terrorist organizations.

[As an interesting aside, though, the Justice Department has argued (in the Operation Backfire cases) that the ALF/ELF have an "international" element, and that ELF defendants had international support.]
