It was described by the <em>ABA Journal</em> as one of &#8220;the best Web sites by lawyers, for lawyers.&#8221; I was invited to contribute a commentary on the Animal Enterprise Terrorism Act.</p>
<p>Here&#8217;s an excerpt:</p>
<blockquote><p><span style="font-size: small;">A </span>recent undercover investigation into one of the nation&#8217;s largest egg producers, Sparboe Farms, documented hens mangled in cage wire, many with open wounds, and chicks having their beaks burned off by workers. This is just one of many investigations by animal welfare advocates that have exposed standard industry practices, created national dialogue about factory farming and in some cases prompted criminal charges. Newly released FBI documents show that the government is less concerned about these abuses and more concerned about the economic loss caused to businesses. The FBI has also been keeping files on factory farm investigators, and recommends prosecuting them as terrorists.<span id="more-5646"></span></p>
<p>It may come as a shock to most people to learn of potential terrorism charges for investigators who, at worst, have trespassed or rescued a few injured animals. Yet, this is merely the latest chapter of a long-running campaign. I have documented how corporations created the term &#8220;eco-terrorism&#8221; in the 1980s and then used public relations campaigns, congressional hearings and ambitious court cases to manufacture what the FBI calls the &#8220;number one domestic terrorism threat.&#8221;</p>
<p>Perhaps the most dangerous tactic employed by corporations has been the manipulation of post-9/11 fears to enact designer terrorism legislation. Foremost among these new laws is the Animal Enterprise Terrorism Act (AETA). The act was passed in 2006 at the request of the National Association for Biomedical Research, Fur Commission USA, GlaxoSmithKline, Pfizer, Wyeth, United Egg Producers, National Cattlemen&#8217;s Beef Association and many other corporations and business groups that have a financial stake in silencing animal rights activists.</p></blockquote>

<p>I created this list according to the number of views each article on this website received. I think some of the stories are more significant than others, but the order really isn&#8217;t important.</p>
<p>More important are the trends they reflect.</p>
<p>The first trend is an increasingly aggressive campaign led by corporations against those who effectively threaten profits. I have been writing this blog since 2006, when the Animal Enterprise Terrorism Act was being debated. If you had told me then that there would be a campaign in multiple states to criminalize undercover investigations, or that environmentalist Tim DeChristopher would receive two years in prison for civil disobedience, I wouldn&#8217;t have believed you. On top of that, the hubris of corporations and politicians is also being codified into law in new ways, such as the National Defense Authorization Act, and these tactics are spreading to other countries.</p>
<p>When you stack things up that way, it&#8217;s pretty grim.</p>
<p>But that&#8217;s only half of the story.</p>
<p>As Tim DeChristopher was being sentenced to prison for non-violent civil disobedience, activists around the country didn&#8217;t cower in fear. Thousands protested the creation of the Keystone XL pipeline, and hundreds were arrested saying, <a href="http://www.commondreams.org/view/2011/07/27" target="_blank">&#8220;now it&#8217;s our turn.&#8221;</a> And as new FBI documents reveal that the government has considered terrorism prosecutions against non-violent undercover investigators, activists have hit back with a lawsuit calling the Animal Enterprise Terrorism Act unconstitutional.</p>
<p>In other words, the second trend is that resistance is growing.</p>
<p>What&#8217;s in store for 2012? The Occupy Wall Street movement has gone from a few dozen tents to a national movement in about 100 days. As more and more people recognize that they are part of the &#8220;99 percent,&#8221; and act accordingly, Occupy will undoubtedly attract a proportionate backlash from same &#8220;one percent&#8221; who have targeted animal rights and environmental activists for decades.</p>
<p>There are significant challenges ahead for all of us. It&#8217;s hard to know what is the best way to take action, or how we should proceed. But I think Woody Guthrie was on to something with his <a href="http://boingboing.net/2011/12/19/woody-guthries-new-years-r.html" target="_blank">New Year&#8217;s resolution list from 1942</a>.</p>
<p>Two of the items on his list for the new year: <em>&#8220;Make up your mind&#8230; Wake up and fight.&#8221;</em></p>

<p>The lawsuit was filed by the Center for Constitutional Rights on behalf of 5 longtime animal rights activists. The activists say the vague wording of the law, and the <a href="http://www.greenisthenewred.com/blog/green-scare" target="_blank">corporate-led campaigns against animal rights activism</a>, have made them alter their own advocacy.</p>
<p>The landmark case has implications for all social justice movement, beyond the animal rights activists targeted. It sets a dangerous precedent for labeling anyone who effectively threatens corporate profits a &#8220;terrorist.&#8221; As the Occupy Wall Street Movement grows rapidly, and has begun reclaiming foreclosed homes from banks and shutting down ports, this lawsuit couldn&#8217;t come at a more pressing time. And with the impending passage of the <a href="http://www.greenisthenewred.com/blog/national-defense-authorization-act-indefinite-detention-citizens/5365/" target="_blank">National Defense Authorization Act</a>, the dangers of this parallel legal system for &#8220;terrorists&#8221; has become strikingly clear.</p>
<p>The lawsuit seeks to strike down the law for violating the First and Fifth Amendments [read the criminal complaint in<em><a title="Blum v Holder Animal Enterprise Terrorism Act lawsuit complaint" href="http://www.greenisthenewred.com/blog/wp-content/Images/Blum-v-Holder-Complaint.pdf" target="_blank"> Blum v. Holder</a></em>]. Specifically, it argues that the law is unconstitutional for <strong>3 reasons:<span id="more-5397"></span></strong></p>
<ol>
<li><strong>It is so broad that it has had a chilling effect on free speech. </strong>The law hasn&#8217;t outlawed animal rights activism, but it has made activists think twice about using their rights. This was the primary point I raised in my Congressional testimony against the law in 2006, and since then the political climate has become even more toxic. The <a href="http://www.greenisthenewred.com/blog/aeta-4-case-thrown-out-dismissed/3015/" target="_blank">first use of the law</a> was based on activists allegedly chalking slogans on the sidewalk and wearing bandanas. The Animal Enterprise Terrorism Act is an attempt by corporations to <a href="http://www.greenisthenewred.com/blog/coping-with-repression-the-chilling-effect-of-eco-terrorism-rhetoric/81/" target="_blank">use the power of fear in order to silence their opposition</a>.</li>
<li><strong>The language is so vague that people can&#8217;t decipher what is illegal. </strong>The law&#8217;s criminalization of &#8220;interfering with&#8221; the operations of an animal enterprise, or causing a &#8220;loss of profits,&#8221; leave activists wondering if they could be labeled a terrorist for a successful lawful campaign. This is compounded by the law&#8217;s emphasis on &#8220;tertiary targeting&#8221;: it not only protects animal enterprises,&#8221; but any business <em>that does business with</em> an animal enterprise. When politicians, the courts, lawyers, and national organizations cannot agree on the meaning of this law, it is dangerously overbroad.</li>
<li><strong>It singles out animal rights activist because of their political beliefs and their effective advocacy. </strong>Meanwhile, violence by anti-abortion extremists is not being labeled as terrorism. For more on this:<a href="http://www.greenisthenewred.com/blog/sarah-palin-terrorism-giffords/3403/" target="_blank"> &#8220;If Sarah Palin Were an Animal Rights Activist, She’d Have Already Been Convicted of &#8216;Terrorism</a>.&#8221; Singling out groups of people because of their political beliefs, and restricting their First Amendment rights, is antithetical to a healthy democracy.</li>
</ol>
<p>Here is a detailed, step-by-step <a href="http://www.greenisthenewred.com/blog/aeta-analysis-109th/" target="_blank">analysis of the Animal Enterprise Terrorism Act</a> if you are interested. I wanted to focus a bit on the people involved in the lawsuit, though:</p>
<p><strong>Sarahjane Blum</strong> has been an animal rights activist for 23 years. She co-founded GourmetCruelty.com in 2003, which exposed the cruelty of the foie gras industry and helped California to ban foie gras farming. According to the lawsuit: &#8220;While she had knowingly and openly violated the law many times through acts of non-violent civil disobedience, she was unwilling to face the possibility of prosecution and sentencing as a terrorist. <em>She was stunned that the ethical, important work that she had devoted her life to had been turned overnight into terrorism.</em>&#8221;</p>
<p><strong>Ryan Shapiro </strong>is now a doctoral candidate at MIT studying the history of political repression against animal rights activists. With Sarahjane Blum, he co-founded <a href="http://www.GourmetCruelty.com" target="_blank">GourmetCruelty.com</a>, produced a documentary film, and spoke publicly about his work. He was also friends with the <a href="http://www.greenisthenewred.com/blog/shac-7-conviction-upheld-on-appeal/2307/" target="_blank">SHAC 7</a> &#8212; a group of activists convicted as terrorists. &#8220;Faced with the imprisonment of his friends, and with the passage of the AETA, Mr. Shapiro began to worry that the price for peaceful protest and civil disobedience was one he could not afford to pay.&#8221;</p>
<p><strong>Lana Lehr </strong>has organized for the welfare of rabbits, and also protested the sale of their fur. After the passage of the AETA, she found herself altering her protest activity and censoring her words and her writing online.</p>
<p><strong>Lauren Gazzola</strong> is one of the SHAC 7. She recounts a lecture she gave at a law school class where she censored herself from encouraging activists to follow her advocacy, because she feared her words would be used as evidence of conspiracy to violate the AETA.</p>
<p><strong>Jay Johnson, </strong>who has confirmed that he has been placed on a terrorist watchlist, has witnessed the chilling effect on grassroots animal rights activism. After the case of the SHAC 7 and the passage of the AETA, protest attendance plummeted. For instance, he recounts a protest against a company affiliated with Huntingdon Life Sciences: &#8220;When he arrived at the site of the planned protest, he was met by over 40 police officers in riot gear, and not a single other protestor.&#8221;</p>
<p>In the interest of full disclosure, I have known several of these plaintiffs for well over a decade, as activists and as friends.</p>
<p>I point this out because I want to take the liberty of saying that this lawsuit was not an easy decision for them. There&#8217;s of course a fear of drawing a giant red target on one&#8217;s back, but the primary concern of these plaintiffs is not themselves &#8212; it&#8217;s the animals, and those advocating on their behalf. All of these activists are deeply committed to the animal rights movement, and they had to answer the uncomfortable question: &#8220;Does acknowledging fear draw even more attention to it? Could this make even more people afraid?&#8221;</p>
<p>But this lawsuit is more about courage than fear. It is about these plaintiffs and the CCR having the courage to acknowledge that this political climate exists, that what we are experiencing is real and it is valid, and that we can&#8217;t move forward by pretending it doesn&#8217;t affect us. It is to say, unequivocally: &#8220;Yes, we have been afraid. Yes, we have all known fear. And now it is time to fight back.&#8221;</p>

			<content:encoded><![CDATA[<p></p><p><a href="http://www.greenisthenewred.com/blog/tag/shac-7"><img class="alignright" title="shac 7" src="http://www.greenisthenewred.com/blog/wp-content/Images/shac7_group.jpg" alt="shac 7 " width="302" height="234" /></a>The Supreme Court announced today that it will not review the case of the SHAC 7, a landmark First Amendment case in which a group of animal rights activists were convicted as &#8220;terrorists&#8221; for running a controversial website.</p>
<p>The campaign of the <a href="http://www.greenisthenewred.com/blog/tag/shac-7/" target="_blank">SHAC 7</a> didn’t involve anthrax, pipe bombs, or a plot to hijack an airplane. They ran a website. On that website, they posted news about the campaign — legal actions like protests and illegal actions like stealing animals from labs — and unabashedly supported all of it.</p>
<p>For this they faced a slew of conspiracy charges, including conspiracy to violate the <a href="http://www.greenisthenewred.com/blog/tag/animal-enterprise-protection-act" target="_blank">Animal Enterprise Protection Act</a> and commit &#8220;animal enterprise terrorism.&#8221;</p>
<p>The defendants lost at the trial level, and were sentenced to between one and six years in prison. Upon appeal, <a href="http://www.greenisthenewred.com/blog/shac-7-conviction-upheld-on-appeal/2307/" target="_blank">the Third Circuit issued a sweeping ruling</a>. It held that SHAC&#8217;s fiery rhetoric constituted a “true threat&#8221; (even though they were never accused of destroying property, or violence, or inciting such activity) because illegal conduct has taken place in the same campaign.</p>
<p>To put it another way, the court held that the First Amendment rights of a group of people could be restricted based on the past actions of others.</p>
<p>For instance, one of the defendants<span id="more-4447"></span>, Josh Harper, gave two speeches in which he talked about the campaign, and also his personal, theoretical support for the Animal Liberation Front and &#8220;black faxing.&#8221; The appellate court noted:</p>
<blockquote><p>Harper’s personal conduct does not cross the line of illegality; to punish him simply on the basis of his political speeches would run afoul of the constitution. However, his conduct&#8230; does provide circumstantial evidence from which a jury could have reasonably inferred that Harper was involved in a conspiracy to violate the AEPA.</p></blockquote>
<p>The Supreme Court has denied writ of certiorari in the case, which means the case will not be heard. In short, the appeals court ruling stands, and this is the end of the line for the SHAC 7.</p>
<p>The chances of a case being heard by the Supreme Court are incredibly slim, of course. But I&#8217;m a bit surprised the court will not hear the SHAC 7 case. The Supreme Court recently <a href="http://www.washingtonpost.com/wp-dyn/content/article/2011/03/03/AR2011030304124.html" target="_blank">ruled that Westboro Baptist Church </a>(the &#8220;God Hates Fags&#8221; folks) have the right to protest military funerals. Chief Justice John G. Roberts Jr. wrote that their conduct &#8220;is certainly hurtful and its contribution to public discourse may be negligible,&#8221; but it is protected, nonetheless.</p>
<p>All but one of the SHAC 7 defendants have been released from prison,  so this ruling was not about prison time. It was about the precedent  that this type of ruling may set, particularly in the context of the <a href="../tag/animal-enterprise-terrorism-act" target="_blank">Animal Enterprise Terrorism Act</a>. And it was about whether that label, &#8220;terrorist,&#8221; should follow these activists for the rest of their lives.</p>
<p>Even if you do not agree with the SHAC campaign, or animal rights campaigns in general, the Supreme Court&#8217;s refusal to hear this case has chilling implications for all activists of all social justice movements.</p>
<p>UPDATE: Here&#8217;s a response from Lauren Gazzola, one of the SHAC 7:</p>
<blockquote><p>&#8220;Today has been a hard day, because I think that the Supreme Court&#8217;s denial of our cert. petition was wrong.  Not just legally wrong, but morally wrong.  In that sense, I&#8217;ve had many hard days over the past several years.  Right now though, I&#8217;d like to tell you about one of the easiest.</p>
<p>A few weeks ago I gave a talk about the SHAC 7 case to a law school class.  Before I got up to speak, the professor showed undercover footage from inside of HLS.  It was the first time I&#8217;d seen it since getting out of prison and I broke down.  When it ended, the Executive Director of the National Antivivisection Society got up to introduce me.  &#8220;It&#8217;s hard to know where to start,&#8221; she began.</p>
<p>I was next up and still slightly shaky from having seen the footage. I had planned to begin by thanking the professor for inviting me,<br />
thanking NAVS for sponsoring the event, and thanking the students for attending.  Instead I told the class, &#8220;I know exactly where to start.</p>
<p>I spent three-and-a-half years of my life trying to put HLS out of business and three-and-a-half years in prison for it.  Every single day was worth it and I&#8217;d do it again.&#8221;  Today, I&#8217;d simply like to repeat this: I&#8217;d do it again.  It was all worth it.&#8221;</p></blockquote>

<p>The Counter-Terrorism Unit, a division of the Bureau of Prisons, is listing prisoners who are environmentalists and animal rights activists alongside the Army of God and Aryan Nations.</p>
<p>The animal rights and environmental movements in the United States have never harmed a single human being, according to the FBI and DHS, but new internal documents show that prison officials classify these activists as &#8220;domestic terrorists&#8221; along with much more dangerous prisoners.</p>
<p>Earlier this week I reported on the <a href="http://www.greenisthenewred.com/blog/counter-terrorism-unit-prisoner-reports/3411/" target="_blank">internal intelligence documents that are distributed by the Counter-Terrorism Unit</a> to prison officials and law enforcement. The unit monitors the letters, visits and phone calls of &#8220;terrorist prisoners&#8221; to identify any potential threats.</p>
<p>For example, some of the &#8220;domestic terrorists&#8221; monitored include: <span id="more-3451"></span></p>
<ul>
<li><strong>Clayton Lee Waagner</strong>, a member of the Army of God who plotted to murder abortion clinic employees. He was found guilty of more than fifty federal charges including threatening to use a weapon of mass destruction.</li>
<li><strong>Buford Furrow</strong>, a member of the Aryan Nations convicted for the shooting at the Los Angeles Jewish Community Center that injured three children and killed one person.</li>
</ul>
<p>The Counter-Terrorism Unit also lists a section for &#8220;Domestic Terrorism &#8211; Environmental Extremism.&#8221; The activists listed are much different from the Waagners and Furrows of the world:<a href="http://info.publicintelligence.net/BOP-CTU-2.pdf"><img class="alignright size-medium wp-image-3453" title="counter_terrorism_unit_environmental_extremism" src="http://www.greenisthenewred.com/blog/wp-content/Images/counter_terrorism_unit_environmental_extremism-231x300.jpg" alt="Counter Terrorism Unit intelligence summary" width="231" height="300" /></a></p>
<ul>
<li><strong>Daniel McGowan</strong>, convicted for his role in two arsons targeting genetic engineering and the logging of old-growth forests.</li>
<li><strong>The <a href="http://www.greenisthenewred.com/blog/shac-7" target="_blank">SHAC 7</a></strong>, a group of animal right activists convicted of &#8220;conspiracy to commit animal enterprise terrorism&#8221; for running a website that listed personal information about corporate executives, and supported property destruction.</li>
</ul>
<p>The documents also include a section titled &#8220;Upcoming Domestic Terrorist Releases,&#8221; which list prisoners, their release dates, and &#8220;association.&#8221; For animal rights and environmental activists, the &#8220;associations&#8221; are often incorrect. For example: members of the SHAC 7  are sometimes listed as &#8220;ALF/ELF&#8221; (for Animal Liberation Front and Earth Liberation Front) even though they have never been accused of a crime by those groups. The terrorist label is applied recklessly based loosely on perceived political beliefs.</p>
<p>These internal documents make clear that the labeling of activists as &#8220;eco-terrorists&#8221; is much more than public relations ploy by corporations and the politicians who represent them. The <a href="http://www.greenisthenewred.com/blog/green-scare" target="_blank">&#8220;number one domestic terrorism threat&#8221;</a> rhetoric has worked its way into the top levels of government, and has saturated the entire criminal justice system.</p>
<p>Activists are being labeled &#8220;eco-terrorists&#8221; before they even set foot in a court room and, if convicted, that label follows them into the prison system where it legally redefines them. They can end up in secretive political prisons called <a href="http://www.greenisthenewred.com/blog/cmu-proposal-domestic-guantanamo/2660/" target="_blank">Communications Management Units</a>. And even if they don&#8217;t, law enforcement and prison officials are receiving bulletins like these, which serve to only further instill fear.</p>

			<content:encoded><![CDATA[<p></p><p><a href="http://www.boingboing.net/2011/01/08/congresswoman-gabrie.html" target="_blank"><img class="alignright size-medium wp-image-3405" title="palin_terrorism_reload_map" src="http://www.greenisthenewred.com/blog/wp-content/Images/palin_terrorism_reload_map-189x300.png" alt="palin_terrorism_reload_map" width="189" height="300" /></a>Spokespersons for Sarah Palin and Tea Party groups have <a href="http://www.cbsnews.com/8301-503544_162-20027939-503544.html?tag=cbsContent;cbsCarousel">bristled at the suggestion</a> that their violent rhetoric may have contributed to the recent shooting in Arizona that left six people dead and Democratic Congresswoman Gabrielle Giffords in critical condition. The topic is, for the most part, being treated with kid gloves in the press, and the &#8220;terrorist&#8221; label is conspicuously absent from the discussion.</p>
<p>However, animal rights and environmental activists have been labeled as &#8220;terrorists,&#8221; and sent to prison, for much, much less.</p>
<p>The murder attempt of Gabrielle Giffords needs to be put in a political context: Sarah Palin&#8217;s PAC used this map with gun targets on lawmakers, including Giffords; Palin has repeatedly used the rallying cry &#8220;Don&#8217;t Retreat, Instead &#8211; RELOAD!&#8221;; Tea Partiers have carried assault rifles to political rallies; and militia members have urged followers to <a href="http://www.greenisthenewred.com/blog/tea-party-terrorist/2616/" target="_blank">vandalize the offices of politicians</a> (including Giffords), which they have done.</p>
<p>As I have reported here many times previously, none of this is being labeled terrorism by the government. Meanwhile, the animal rights and environmental movements are labeled the <a href="http://www.greenisthenewred.com/blog/green-scare" target="_blank">&#8220;number one domestic terrorism threat.&#8221;</a></p>
<p>To draw an even more specific comparison:<span id="more-3403"></span> the <a href="http://www.greenisthenewred.com/blog/shac-7" target="_blank">SHAC 7</a> were convicted of &#8220;animal enterprise terrorism&#8221; for running a website which posted the names and addresses of individuals tied to the animal testing lab Huntingdon Life Sciences. They were not charged with any act of property destruction, they were charged with &#8220;conspiracy&#8221; on the grounds that they should be held accountable for the actions of others in the same movement.</p>
<p>To be clear, I am not arguing that Sarah Palin <em>should</em> be accused of terrorism. However, such a stark hypocrisy needs to be addressed. </p>
<p>Simply put:</p>
<p>If Sarah Palin cannot be held responsible for the actions of those who visit her website, neither can animal rights activists. </p>
<p>And if animal rights activists are terrorists for running a website listing &#8220;targets,&#8221; then Tea Partiers and Sarah Palin, who have gone much further, must be labeled terrorists as well. </p>
<p>UPDATE: Well, it was only a matter of time. At least one person is proposing <a href="http://terrortrials.blogspot.com/2011/01/sarah-palin-should-be-prosecuted-for.html">prosecuting Palin as a terrorist and using the SHAC 7 case as justification</a>. It&#8217;s this type of sweeping application that SHAC 7 attorneys have been warning about for years. </p>

			<content:encoded><![CDATA[<p></p><p><a href="http://www.greenisthenewred.com/blog/shac-7"><img alt="shac 7 " src="http://www.greenisthenewred.com/blog/wp-content/Images/shac7_group.jpg" title="shac 7" class="alignright" width="302" height="234" /></a>Last week <a href="http://www.nj.com/news/times/regional/index.ssf?/base/news-20/127614873745490.xml&#038;coll=5">a Philadelphia appellate court announced</a> (after months of silence) that it would not revisit the conviction of animal rights activists on terrorism charges. The<a href="http://www.greenisthenewred.com/blog/shac-7"> SHAC 7</a> were convicted of conspiring to commit animal enterprise terrorism by running a controversial website that posted news of both legal and illegal actions, along with personal information of people connected to the notorious animal testing lab Huntingdon Life Sciences. Their campaign had brought the multinational corporation near bankruptcy.</p>
<p>A three-judge panel of the court had previously upheld the conviction, and the defendants had asked that the full court review it. Now, the only option is to request that the Supreme Court of the United States review the case. There has been no official word about this yet, but multiple defendants have expressed their interest and having this landmark First Amendment case heard by the Supreme Court.</p>
<p>Meanwhile, the lead prosecutor who helped secure this &#8220;victory in the War on Terrorism&#8221; has&#8211; surprise, surprise&#8211; been promoted. Charles McKenna is now the head of the New Jersey Office of Homeland Security and Preparedness.</p>
<p>He was <a href="http://www.nj.com/news/index.ssf/2010/06/njit_scientists_homeland_secur.html">quoted a few days ago</a> about his hopes for using new &#8220;anti-terrorism technology&#8221; in his new job. <span id="more-2984"></span></p>
<p>&#8220;We are particularly interested in computer profiling, which is much more sophisticated, and quicker, than traditional racial profiling,&#8221; he said.</p>
<p>The targets of this new profiling technology? </p>
<p><strong>&#8220;Jihad, Crips, extreme animal-rights activists, it’s all the same: people trying damage the system,&#8221; added McKenna.</strong>&#8220;We need every trick in the book to avert disaster.&#8221;</p>
<p>As you can see in this photo, <a href="http://www.youtube.com/watch?v=21OH0wlkfbc">the SHAC 7 are quite gangsta</a>.  But no reasonable person could argue that they are the &#8220;same&#8221; as violent street gangs and Islamic terrorists.</p>
<p>Such absurd scare-mongering rhetoric has become normal for corporations, industry groups, and the politicians who represent them. When it is adopted by government officials who are in charge of keeping us safe, though, it has frightening implications. </p>
<p>There are limited anti-terrorism and law enforcement resources. When people like McKenna let shameless political opportunism shape security priorities (and make no mistake, this is nothing but political opportunism&#8211;he has already been rewarded for defending the &#8220;system&#8221; from activists), it puts everyone at risk.</p>

</div>Tea Party groups and right-wing militias have been <a href="http://news.yahoo.com/s/politico/20100324/pl_politico/34907">plotting attacks on Muslims, throwing bricks through lawmakers&#8217; windows, and issuing death threats</a>, yet the mainstream press and the federal government have not labeled these acts &#8220;terrorism.&#8221; </p>
<p>By contrast, the <a href="http://www.greenisthenewred.com/blog/green-scare">&#8220;number one domestic terrorism threat,&#8221;</a> according to the FBI, is the animal rights and environmental movements.  </p>
<p>Here is a side-by-side comparison of three recent right-wing cases which have not been labeled terrorism, and how they compare to activist cases that have.</p>
<ul>
<li><strong>Militia member incites brick attacks on lawmakers&#8217; offices.</strong> Mike Vanderboegh, former militia member from Alabama, <a href="http://www.washingtonpost.com/wp-dyn/content/article/2010/03/25/AR2010032501722.html">urged readers of his blog to throw bricks through Democratic offices</a> in response to health care legislation. &#8220;So, if you wish to send a message that Pelosi and her party [that they] cannot fail to hear, break their windows,&#8221; Vanderboegh wrote. &#8220;Break them NOW&#8230;&#8221; The call to action worked: in the week that followed at least 10 lawmakers had offices vandalized or received death threats.
<p><a href="http://www.greenisthenewred.com/blog/shac-7/">Six animal rights activists were convicted of &#8220;animal enterprise terrorism&#8221;</a> for doing much less. They were part of Stop Huntingdon Animal Cruelty, and ran a website that posted personal information about executives tied to the controversial lab Huntingdon Life Sciences. They posted both news reports of both legal and illegal actions, and supported all of it. They also published essays about why they support non-violent direct action and sabotage. They were sentenced to between 1 and 6 years in prison. And the former militia member? <span id="more-2616"></span>He hasn&#8217;t even been arrested.</li>

<li><strong>Plotting to attack Muslims and police, and use a weapon of mass destruction.</strong> The Christian militia group called Hutaree is shown in one of their promo videos here. <a href="http://www.nytimes.com/2010/03/30/us/30militia.html?src=me">According to <em>The New York Times</em></a>, the defendants were &#8220;part of a group of apocalyptic Christian militants who were plotting to kill law enforcement officers in hopes of inciting an antigovernment uprising, the latest in a recent surge in right-wing militia activity.&#8221;
<p><em>The New York Times</em> doesn&#8217;t call this racist, political violence &#8220;terrorism.&#8221; Yet a group of environmentalists who sabotaged property as part of the Earth Liberation Front<!--more-->, without harming or intending to harm a single person, were <a href="http://www.nytimes.com/2005/12/09/national/09ecoterror.html">smeared as terrorists immediately upon arrest</a>. <em>The Times</em> used the word in the headline, throughout the story, and in all subsequent coverage. </li>
<li><strong>Urging Tea Partiers to &#8220;reload.&#8221;</strong> Sarah Palin told a rally of 8,000 tea-partiers: <a href="http://latimesblogs.latimes.com/washington/2010/03/sarah-palin-speech-tea-party-nevada.html">&#8220;It&#8217;s not a time to retreat. It&#8217;s a time to reload.&#8221;</a>
<p>Animal rights activists have been charged with terrorism for much less fiery speech. The <a href="http://www.greenisthenewred.com/blog/animal-rights-activists-indicted-as-terrorists-for-home-protests/1657/">AETA 4</a>, for example, are not accused of property destruction or threats of violent. They are being charged under the <a href="http://www.greenisthenewred.com/blog/aeta">Animal Enterprise Terrorism Act</a> for protesting and chalking slogans on the streets using children&#8217;s sidewalk chalk. </p>
<p>To be clear, I am not arguing that Palin&#8217;s comments should be labeled terrorism. But what do you think would happen if an animal rights activists or environmentalist made the same comment, but about animal researchers?</li>
</ul>
<p>The word terrorism is inherently malleable. There is not one true meaning of the word, no universal criteria for its application. However, these dramatic disparities extend far, far beyond any natural difficulties in using the term fairly. </p>
<p>People are being singled out for selective prosecution because of their politics and their threat to corporate profits. Once convicted, they are then being singled out again; Daniel McGowan, one of the Earth Liberation Front defendants, is in a <a href="http://www.greenisthenewred.com/blog/5-things-little-guantanamo-cmu/2583/">secretive experimental prison called a Communications Management Unit. </a></p>
<p>Meanwhile, groups that pose a much more serious threat to human life, and have a demonstrated history of violence, go untouched. If the word terrorism is rhetorically and legally applied to non-violent animal and environmental activists, it must also be applied to much more dangerous groups. </p>
<p>That being said, it is not enough for us to respond by saying &#8220;They&#8217;re terrorists too!&#8221; or &#8220;We&#8217;re not terrorists, they are!&#8221; </p>
<p>Clamoring to label others as terrorists misses the point, which is that the word, the most dangerous and powerful term in the media and in our legal system, is nothing more than a fluid brand to attack the enemy of the hour.</p>
