<p>We discussed the case of Daniel McGowan, a former Earth Liberation Front member, who is currently in a secretive prison called a <a href="http://www.greenisthenewred.com/blog/tag/communications-management-units/" target="_blank">Communications Management Unit</a>. Also on the program were <a href="http://www.greenisthenewred.com/blog/andy-stepanian-communication-management-unit/2181/" target="_blank">Andy Stepanian, who is the first prisoner to be released from a CMU,</a> and Marshall Curry, director of <a href="http://www.ifatreefallsfilm.com/" target="_blank">If a Tree Falls</a>.</p>
<p>Because so much of the discussion was focused on Daniel McGowan, arson, and the Earth Liberation Front, it raises a lot of questions about tactics. These are important discussions that need to take place within the environmental movement, and I agree with Marshall Curry&#8217;s concluding thought that activists must &#8220;think carefully&#8221; about what tactics they choose.</p>
<p>However, if we are to move forward, we need to focus even more attention on the truly radical tactics of corporations and the politicians who represent them.<span id="more-4963"></span> They have manufactured this &#8220;eco-terrorism&#8221; threat, and they are widening their net, eroding checks and balances on government power, in order to demonize and silence their opposition.</p>
<p>Corporations have made quite clear that it is not solely the tactics that matter&#8211; it is whether those tactics are <strong>effective</strong>. That&#8217;s why environmentalist <a href="http://www.greenisthenewred.com/blog/tim-dechristopher-speech-courthouse-video/4394/" target="_blank">Tim DeChristopher is facing 10 years in prison</a> not for arson, but for non-violent civil disobedience. That&#8217;s why legislation has been introduced in multiple states not targeting death threats and violent posturing, but <a href="http://www.onthemedia.org/transcripts/2011/05/27/04" target="_blank">targeting undercover videos</a>.</p>
<p>The case of Daniel McGowan and others should prompt a critical examination of the tactics employed by animal rights and environmental activists, but that introspection is absolutely worthless unless it is accompanied by a parallel critique of the tactics used by corporations to push their extremist agenda.</p>

I certainly hadn&#8217;t, until I began researching the web of faceless &#8220;risk mitigation&#8221; companies that help corporations identify threats to their profits. </p>
<p>These companies produce briefing documents that identify business &#8220;threats,&#8221; including special interest groups, key activists, and legislation. It is a niche industry built upon fear: the business of risk mitigation depends upon the identification of a constant stream of threats. Corporations commission briefing documents which identify (or create) threats to corporate interests, which leads corporations spending money addressing these threats, which leads to more reports&#8230; you get the idea. </p>
<p>This financial motivation to identify threats results in some interesting reports. For instance, I previously wrote about the Society of Toxicology commissioning a &#8220;threat analysis&#8221; that included such detailed information as <a href="Corporations Tracking Who Activists Are Dating">who animal rights activists are dating</a>.<span id="more-571"></span></p>
<p>It is impossible to know the true scope of these reports, and the impact they have had on the broader political climate of the <a href="http://www.greenisthenewred.com/blog/green-scare">Green Scare</a>. It is fair to say, though, that for many corporate executives, these think tank documents may be the only exposure they have had to the history, motivation and tactics of the animal rights and environmental movements. They are a critical component of broader efforts to label activists (the &#8220;threats&#8221;) as &#8220;terrorists.&#8221;</p>
<p>One such report is by the <a href="http://www.inkerman.com/index">Inkerman Group</a>, called <a href="http://www.greenisthenewred.com/blog/wp-content/Images/inkerman_report_ecoterror.pdf">&#8220;The War on &#8216;Eco-Terror&#8217;: An analysis of the use of anti-terrorism legislation on activist movements in the UK &#038; US.&#8221; </a>It was sent to me with the request that I not identify the commissioner of the report. (The report, from 2007, is marked &#8220;confidential&#8221; and does not show up in a search of the Inkerman website, but a Google search of the volume number returns a <a href="http://www.inkerman.com/static/files/1197479765-theinkermanmonitorecoterror.pdf">back-end link to the source document</a> on the Inkerman server. Good thing Inkerman is not a security firm, I guess.)</p>
<p><a href="http://www.greenisthenewred.com/blog/wp-content/Images/changing_the_climate_bumper_sticker.jpg"><img src="http://www.greenisthenewred.com/blog/wp-content/Images/changing_the_climate_bumper_sticker-300x158.jpg" alt="" title="changing_the_climate_bumper_sticker" width="300" height="158" class="alignright size-medium wp-image-2942" /></a>Like many other risk analyses, the Inkerman report is hilariously bad at times. The authors of the report appear to either be quite clueless about the true nature of the radical environmental movement, or quite malicious in their attempts to label mainstream, non-violent tactics as &#8220;terrorism.&#8221; </p>
<p>For instance, its timeline of &#8220;eco-terrorism&#8221; begins with the formation of the Sierra Club in 1892, and the formation of the Humane Society of the United States in 1954. </p>
<p>It goes on to identify key developments in the radical environmental movement, including&#8230; stickers. </p>
<blockquote><p>Towards the end of 2000, a new form of eco-terrorism emerged in the US against Sports Utility Vehicles (SUVs). Activists, some reportedly part of the ELF, decided to demonstrate against the environmentally-unfriendly vehicles by placing homemade stickers on them. These ‘Mad Taggers’, as they became known, used to sticker the cars in question, chosen at random with messages such as &#8220;I&#8217;m Changing the Climate. Ask Me How&#8221;, &#8220;Bin Laden Used Your Gas Money&#8221;, &#8220;If You Love America, Get Rid of Your SUV&#8221; and &#8220;I Don&#8217;t Care About the Air&#8221;.
</p></blockquote>
<p>However, despite these claims and despite the financial interests involved in this report, the authors do not side in favor of more &#8220;eco-terror&#8221; legislation.</p>
<blockquote><p>The introduction of new anti-terror laws seems only to be further complicating the definition of terrorism and what constitutes it, rather than clarifying it. This inherently implies that the Government is still struggling with legally defining the term ‘eco-terrorism’.</p>
<p>In today’s terror climate, the authorities’ fear that terrorist individuals and organisations may ‘slip through the net’ has justified the use of wide-ranging legislation against activists. Many times, actions of ‘eco- terrorists’ are perpetrated to induce fear, and this should rightly be clamped down upon and prosecuted. However, where peaceful protest such as the Camp for Climate Action 2007 intends not to disrupt or threaten human security, the threat alone of anti-terrorist legislation being used against protest is extreme. The issue lies in the blurring of lines between those extremists willing to carry out eco-tage, and those looking to undertake peaceful protest, which should be encouraged in a democracy. This is especially problematic where the two kinds of protests exist side by side at a demonstration, or within groups.</p>
<p><strong>In contrast with the US, which declares eco-terrorism to be the most serious form of domestic terrorism today, the UK must respect the fine lines between democratic voice, illegal activity, terrorism and scare- mongering.</strong> [Emphasis added]</p></blockquote>
<p>Unfortunately, corporations in the United States have not gotten the memo.</p>

		<title>20 Years Later: Remembering the Bombing of Judi Bari</title>

		<description><![CDATA[Lessons from the car-bombing of Judi Bari and Darryl Cherney, two Earth First! activists, 20 years ago. ]]></description>
			<content:encoded><![CDATA[<p></p><p><a href="http://www.greenisthenewred.com/blog/wp-content/Images/judi_bari.jpg"><img src="http://www.greenisthenewred.com/blog/wp-content/Images/judi_bari.jpg" alt="judi bari" title="judi_bari" width="200" height="296" class="alignright size-full wp-image-2923" /></a>Twenty years ago today, Judi Bari and Darryl Cherney, two prominent Earth First!ers, were in Oakland protesting clearcutting. They had been on the road organizing Redwood Summer, a <a href="http://www.counterpunch.org/roselle03062007.html">campaign to save old-growth forests inspired by the Freedom Summer</a> of the civil rights movement. </p>
<p>Bari had already received dozens of death threats for her campaigning. She had drawn quite a bit of attention from opposition in the logging industry because of her effective organizing. As kp wrote in the<a href="http://www.earthfirstjournal.org/article.php?id=496"><em> Earth First! Journal</em> </a>recently: </p>
<blockquote><p>She brought us lessons from her background as a labor organizer and analysis that helped evolve our radical thinking both philosophically and strategically. </p></blockquote>
<p>The two were in Bari’s Subaru station wagon when a pipe bomb exploded underneath her, injuring Cherney and nearly killing her. Hours later, while Bari was still in Oakland&#8217;s Highland Hospital, local police arrested them and said they had knowingly transported the bomb—that they were responsible for their own bombing. Police dropped those charges weeks later, but this was just the beginning. <span id="more-2919"></span></p>
<p>Bari and Cherney sued the police and the FBI, alleging false arrest, slander, and conspiracy. They said the government refused to follow any leads in order to smear them. In the opening statement of a two-month trial the prosecutor compared Bari and Cherney to domestic terrorists. </p>
<p>In 2004, fourteen years after the bombing, the federal government agreed to pay $2 million to settle the civil suit, and the city of Oakland agreed to a separate $2 million payment. </p>
<p>It might seem odd that I wanted to mark the 20th anniversary of such a violent and tragic event. I know that I write about plenty of depressing, negative news on this site, so why add to that? </p>
<p>This bombing should be a reminder, I think, of two things. The first is of how far corporations and law enforcement are willing to go in order to silence dissent. This <a href="http://www.greenisthenewred.com/blog/green-scare">buzzword &#8220;eco-terrorism&#8221;</a> is often used alongside the word &#8220;violence,&#8221; but the violence has not flowed both ways. Environmentalists have been assaulted and killed, and they have not responded in kind; that is not the behavior of &#8220;terrorists.&#8221; </p>
<p>The second reminder is much more important. Experiencing a bombing like this, and surviving, must be a traumatic experience. On top of that, the victims were labeled terrorists and demonized in the press. Bari and Cherney, and all of Earth First!, had to deal with public relations attacks alongside the violent attacks, and through this their campaigns continued.</p>
<p>In this context, I think this is an anniversary worth celebrating, one of resilience and courage in the face of seemingly unrelenting violence and repression. </p>

<p>The Supreme Court has <a href="http://www.csmonitor.com/USA/Justice/2010/0420/Supreme-Court-rejects-animal-cruelty-law-upholds-free-speech" target="_blank">struck down a federal law targeting &#8220;depictions of animal cruelty,&#8221; including dog-fighting and &#8220;crush&#8221; videos</a>. And that&#8217;s a very good thing for the animal rights movement.</p>
<p>That might sound incongruous, at best, and heretical, at worst, to animal rights activists. Many people who care about animals have <a href="http://animals.change.org/blog/view/supreme_court_decides_free_speech_vs_animal_cruelty">treated the ruling as a defeat</a>, an attack on their attempts to protect animals from being tortured in the name of entertainment. However, the ruling in <a href="http://www.supremecourt.gov/opinions/09pdf/08-769.pdf"><em>US v. Stevens</em></a> is an important one for animal rights activists for three reasons:</p>
<ol>
<li><strong>Similar legislation could undoubtedly have been used against supporters of the Animal Liberation Front, Earth Liberation Front, and direct action.</strong> Proponents of the legislation, <a href="http://www.law.cornell.edu/uscode/18/usc_sec_18_00000048----000-.html">18 U.S.C. 48</a>, argued that the animal cruelty depicted in such videos is illegal, and it has &#8220;minimum redeeming value.&#8221; To be clear, I am not taking issue with either point. This conduct should be illegal, and it has no more redeeming value, in my opinion, than child pornography. However, the legislation itself is too broad and too vague. Denying First Amendment rights based on whether the media depicts illegal conduct with a &#8220;redeeming value&#8221; is incredibly dangerous. As the court said, it reflects an <a href="http://www.bbc.co.uk/blogs/thereporters/markmardell/2010/04/is_watching_illegal_dog_fights.html">&#8220;alarming breadth.&#8221;</a> These are standards that could easily be tweaked to apply to the publications of animal rights activists themselves.
<p>Within the animal rights and environmental movements there are publications that support property destruction and direct action. Magazines such as <em>No Compromise</em>, <em><a href="http://www.directaction.info">Bite Back</a></em>, and the <em>Earth First Journal</em> support illegal tactics and sometimes include &#8220;how-to&#8221; style columns. There have also been full-length films and activist campaign videos that unabashedly support direct action, and clearly urge others to do the same. (The trailer above is a good example, as are the videos in the campaign to shut down Huntingdon Life Sciences).</p>
<p>I have no doubt that the same industry groups who have sponsored &#8220;eco-terrorism&#8221; legislation would seek to use a similar rational to defend their attacks on publications like Bite Back or films like Behind the Mask. Does that sound far-fetched? Well, <a href="http://www.greenisthenewred.com/blog/washington-eco-terrorism-law-free-speech/2514/"> &#8220;eco-terrorism&#8221; legislation out of Washington State</a> <em>proposed exactly that</em>.</li>
<p><span id="more-2692"></span></p>
<li><strong>Similar legislation could be used to target depictions of animal cruelty produced by activists themselves.</strong> This may seem like another overly-worrisome claim. But if you have been following the tactics of industry groups, it is clear that they are willing to use any and all tools at their disposal, including distorting existing laws and proposing new ones to attack even the most mainstream organizations.

<p>The mob law was never intended to target animal rights activists protesting the circus, and this law was never intended to target undercover investigations by animal rights activists, but in the hands of well-funded corporate industry groups and ambitious prosecutors, vague legislation can be exploited. </p>
<p>What was even more worrisome about this case is that the government defended this fluidity. “Whether a given category of speech enjoys First Amendment protection,&#8221; the government argued, &#8220;depends upon a categorical balancing of the value of the speech against its societal costs.”</p>
<p>Chief Justice Roberts rebuked the Obama administration for that, and rightly so: &#8220;As a free-floating test for First Amendment coverage, that sentence is startling and dangerous.&#8221;</li>
<li><strong>The court made clear that Congress can&#8217;t simply say, &#8220;Trust us, we&#8217;re the government.&#8221;</strong>The court focused much of its arguments on the scope of the legislation, and how it has, and will be, applied. The government responded to concerns about over breadth by promising to only prosecute &#8220;extreme cruelty.&#8221;
<p>In this ruling, the Supreme Court unequivocally rejected those promises.</p>
<p>&#8220;The First Amendment protects against the government; it does not leave us at the mercy of <em>noblesse oblige</em>,” Roberts wrote.<br />
<em><br />
“We would not uphold an unconstitutional statute merely because the government promised to use it reasonably.”</em> [emphasis added]</p>
<p>Similar questions are at the heart of opposition to the <a href="http://greenisthenewred.com/blog/aeta">Animal Enterprise Terrorism Act</a>, legislation so broad it is being used to target activists for <a href="http://www.greenisthenewred.com/blog/aeta-arrests/1070/">chalking slogans on public streets</a>.</p>
<p>When I testified before Congress against the AETA, I argued that it was vague and overly broad, and therefore must be rejected on Constitutional grounds. In response, supporters included a provision that says nothing in the law shall be construed &#8220;to prohibit any expressive conduct (including peaceful picketing or other peaceful demonstration) protected from legal prohibition by the First Amendment.&#8221;</p>
<p>This ruling is an important one because it makes incredibly clear that the government&#8217;s promises, whether only to prosecute depictions of &#8220;extreme cruelty&#8221; or only to prosecute those who support &#8220;extreme&#8221; activism, are meaningless.</li>
</ol>
<p>Some activists have incorrectly portrayed the Supreme Court as ruling that animal cruelty is protected speech. Far from it. The court did not challenge the intent of this legislation, or its value. It simply said that this particular approach, this particular legislation, was too vague and too broad.</p>
<p>To put it another way, this ruling is not about <em>supporting</em> these despicable videos, it is about <em>not prohibiting </em>others. And that&#8217;s a sentiment which will ultimately benefit supporters of both mainstream and &#8220;radical&#8221; animal rights activism.</p>

Big Coal is playing dirty, and has been smearing opponents of their plans as &#8220;eco-terrorists.&#8221; The local press shamefully jumped on the bandwagon, calling Mike Roselle an &#8220;eco-terrorist&#8221; for civil disobedience and warning he <a href="http://www.wchstv.com/newsroom/eyewitness/0902/090210_228eabc6.shtml">&#8220;may put lives at stake in West Virginia.&#8221;</a>. (Roselle is a co-founder of Earth First!, the Ruckus Society and the Rainforest Action Network, and one of the most influential activists in the history of the environmental movement&#8211;and I don&#8217;t think that&#8217;s an overstatement). </p>
<p>Well, that was too much to stomach, even for the guy who claims he invented the term &#8220;eco-terrorist.&#8221; <a href="http://understory.ran.org/2009/02/11/the-no-coal-zone-with-mike-roselle-if-only/">Ron Arnold of the Center for Defense of Free Enterprise said</a>:</p>
<blockquote><p>“I’ve covered Roselle since 1995 and even devoted dozens of pages to his protest activities in my 1997 book EcoTerror: The Violent Agenda to Save Nature. I covered his actions to distinguish between radicals and terrorists. I say he’s a radical environmentalist, not an eco-terrorist. It’s not a crime to be a radical and Roselle has never been charged with any violent crime&#8230; Face it: what he did was civil disobedience, not terrorism. But his opponents are dredging up eco-terror accusations. That’s just hot air and it’s wrong.&#8221;</p></blockquote>
<p>Of course, Arnold goes on to say he feels this way because the &#8220;honorable&#8221; term of &#8220;eco-terrorism&#8221; should not be &#8220;diluted&#8221; by this kind of scare-mongering, so it&#8217;s clear he still firmly stands by the use of the word. But I think it&#8217;s important to note how the usage of &#8220;eco-terrorism&#8221; has strayed beyond even what the architects of the <a href="http://www.greenisthenewred.com/blog/green-scare">Green Scare </a>had intended. </p>
<p>The <a href="http://www.greenisthenewred.com/blog/animal-rights-activists-indicted-as-terrorists-for-home-protests/1657/">AETA 4</a> have been indicted as terrorists for lawful First Amendment activity, the SHAC 7 are in prison for running a website, lawmakers are threatening new legislation to target non-violent activists like <a href="http://www.greenisthenewred.com/blog/utah-bill-would-make-tim-dechristopher-eco-terrorist/1034/">Tim DeChristopher</a>. </p>
<p>As Arnold says, people like Roselle &#8220;may be a terrible pain in the ass, but he’s no terrorist.&#8221; </p>

And the director of &#8220;Twilight&#8221; is set to direct. I feel ill.</p>
<p><em>The Monkey Wrench Gang</em> is Abbey&#8217;s classic tale of George Hayduke, an ex-Green Beret, leading a band of outlaws in a campaign of sabotage to defend the environment. Plenty of folks say the novel influenced the formation of Earth First! and later the Animal Liberation Front and Earth Liberation Front. If you haven&#8217;t read it, please do. </p>
<p>What&#8217;s most bizarre to me about all this is how, in the hands of someone like <a href="http://www.matthewmcconaughey.com/">Matthew &#8220;Just Keep Livin&#8217;&#8221; McConaughey</a> and the &#8220;Twilight&#8221; teenage-vampire crew, a story about property destruction is great fodder for a mass-appeal Hollywood film.</p>
<p>But in the hands of activists, the same narrative, in the form of a children&#8217;s book, is &#8220;eco-terrorism.&#8221; For instance, the government said Daniel McGowan was &#8220;promoting the criminal activity of others&#8221; by linking to the website of <a href="http://www.greenisthenewred.com/blog/terijian/250/"><em>The Secret World of Terijian</em></a>, a children&#8217;s story of a pint-sized Monkey Wrench Gang. (The government even included the full text of the children&#8217;s book in it&#8217;s response to McGowan&#8217;s motion for summary judgment.)</p>
<p>Monkeywrenching can be sexy and fun when it&#8217;s &#8220;just a story&#8221; produced by Hollywood. When the same narratives are connected to political struggles, it&#8217;s &#8220;terrorism.&#8221;</p>

<p>When I reported on their arrest, though, I didn&#8217;t catch an interesting bit of information buried in the <a href="http://www.greenisthenewred.com/blog/wp-content/Images/farrell_arrest_warrant.pdf">government&#8217;s motion for $20,000 cash bond</a>. Mind you, these activists are not accused of any property destruction or violence, they&#8217;re accused of &#8220;conspiracy.&#8221; So how did the government attempt to justify the high cash bond? </p>
<p>According to Farrell&#8217;s motion for bond: </p>
<blockquote><p>&#8220;The defendant has been observed advocating literature and materials which advocate anarchy, property destruction and violence, including &#8216;Ecodefense: A Field Guide to Monkeywrenching&#8217; or &#8216;Recipes for Disaster: An Anarchist Cookbook.&#8217;&#8221;</p></blockquote>
<p>In many ways, this is nothing new: the demonization of anarchists has existed as long as the term itself. But this is dangerous territory for a few reasons:</p>
<ul>
<li>It reflects more wasted resources on surveillance of First Amendment activity. Why was Farrell being &#8220;observed&#8221; by the law enforcement while allegedly &#8220;advocating literature&#8221; in the first place? </li>
<li>It is intended to punish people for their political beliefs. Even if it is true that Farrell was observed advocating literature and that the literature advocated &#8220;anarchy,&#8221; how does this to relate to whether or not he&#8217;ll show up for his court date (which is what bail is all about)? </li>
<li>Criminalizing books has no place in a democracy. Make no mistake, that&#8217;s what this is about: criminalizing dissent. The government isn&#8217;t burning the books, and it isn&#8217;t saying it is illegal to own them, but prosecutors are saying that if you *do* own them or &#8220;advocate&#8221; them it reflects negatively on your character.
<p>In that case, I&#8217;m guilty as well (and I&#8217;m sure I&#8217;m in good company with many of you). I own both of these books, and they are both available in countless bookstores and on Amazon.com. <a href="http://www.amazon.com/Ecodefense-Field-Monkeywrenching-Dave-Foreman/dp/0963775103">&#8220;Ecodefense&#8221;</a> was a pivotal book in the history of the environmental movement, and includes an introduction by Ed Abbey. <a href="http://www.crimethinc.com/books/rfd.html">&#8220;Recipes for Disaster,&#8221;</a> published by CrimethInc., isn&#8217;t the &#8220;anarchist cookbook,&#8221; you might expect: It has sections on coalition building and mental health.</li>
<p>As with so many of the cases I write about on this site, this isn&#8217;t about threats to public safety, it isn&#8217;t about property destruction, it&#8217;s about demonizing people because of their political beliefs. Well, in this case, it&#8217;s not even about that: It&#8217;s about demonizing people because of their books. </p>

			<content:encoded><![CDATA[<p></p><p><a href="http://stopi69.wordpress.com/"><img src="http://www.greenisthenewred.com/blog/wp-content/Images/i69_tree_sit-300x225.jpg" alt="i69_tree_sit" title="i69_tree_sit" width="300" height="225" class="alignright size-medium wp-image-1805" /></a>Two environmental activists in Bloomington, Ind., have been charged with racketeering&#8211;charges originally intended to target the mob&#8211;for allegedly &#8220;conspiring&#8221; to engage in tree sits, participate in non-violent civil disobedience, and make an inflammatory blog post.</p>
<p><a href="http://mostlyeverything.net">Hugh Farrell and Gina &#8220;Tiga&#8221; Wertz</a> are organizers in the campaign to <a href="http://stopi69.wordpress.com/about/">halt expansion of the I-69 NAFTA superhighway</a>. They were arrested on Friday, April 24th, and they&#8217;re each facing five charges that carry a maximum of eight years in prison. </p>
<p>Four of the charges are misdemeanors for &#8220;intimidation&#8221; and &#8220;conversion&#8221; (treating someone else&#8217;s property as your own). All four misdemeanors are related to a civil disobedience stunt where some activists removed the furniture from an I-69 project office, occupied the space, and posted an eviction notice. The government says the civil disobedience stunt was intended to place Ronnie Wilson in fear, and subject him to &#8220;contempt or ridicule.&#8221; </p>
<p>The felony charge is for corrupt business influence, or racketeering. The government isn&#8217;t arguing that these activists were actually engaged in racketeering, but that they are part of Roadblock EarthFirst (described as a criminal enterprise) and &#8220;conspired&#8221; to do so. According to their arrest warrants, <span id="more-1804"></span><a href="http://www.greenisthenewred.com/blog/wp-content/Images/farrell_arrest warrant.pdf">Farrell </a>and <a href="http://www.greenisthenewred.com/blog/wp-content/Images/wertz_arrest warrant.pdf">Wertz</a>:</p>
<ul>
<li>&#8220;Conspired&#8221; to remove office furniture from I-69 project offices as part of eviction notice stunts.</li>
<li>&#8220;Conspired&#8221; to post an &#8220;internet blog on two publicly accessed website stating &#8216;you will suffer the consequences&#8217; and &#8216;perhaps we&#8217;ll go to your homes, children&#8217;s daycare, churches or wherever else you happen to turn your back.&#8221; The blog posts were made after the violent removal of activists from a tree sit.</li>
<li>&#8220;Conspired&#8221; to commit &#8220;theft&#8221; when six individuals blocked the entrance to Gohmann Asphalt and Construction Company using non-violent civil disobedience and caused a loss of profits.</li>
<li>&#8220;Conspired&#8221; to commit &#8220;theft&#8221; by &#8220;taking unauthorized control of trees&#8221; and &#8220;depriving lawful owners of use and/or value of the said trees.&#8221; (Note: the last two bullets are only in Wertz&#8217;s arrest warrant.)</li>
</ul>
<p>Racketeering laws are intended to combat organized crime, such as the mafia, and include crimes like extortion, bribery and money laundering. Although ambitious prosecutors have tried to use the Racketeer Influenced and Corrupt Organizations Act (RICO) to target anti-abortion activists, animal rights activists, and the Hells Angels, the purpose of the law has always been to go after illegal business activity.</p>
<p>But these activists, and others like them, are not protesting this superhighway to make money. They&#8217;re not doing it for personal gain. Halting this environmental destruction will not financially benefit them in any way. </p>
<p>Then why use mob laws against them? Because of their beliefs. </p>
<p>Tree sits, office takeovers and road blockades are against the law, and the government has the tools and resources to prosecute those crimes. </p>
<p>But because of the politics of the alleged crimes, prosecutors are reaching for more. Civil disobedience has become &#8220;theft.&#8221; Tree sits have become &#8220;unauthorized control of trees.&#8221; These trumped-up charges are a way to take what are, at the very worst, misdemeanor crimes and turn them into federal crimes. It&#8217;s an attack on individuals perceived as being leaders in the movement for the sole purpose of stamping out dissent.</p>

</div>The brilliance of the <a href="http://www.greenisthenewred.com/blog/green-scare">“Green Scare”</a> and the War on Terrorism more broadly is how the government and corporations have twisted language to push a political agenda. When environmentalists put their bodies on the line to stop environmental destruction? That’s “eco-terrorism.” When corporations destroy the environment for personal gain? That’s just business as usual.</p>
<p>A great example of the hypocrisy is the <a href="http://www.epa.gov/fugitives/">Environmental Protection Agency’s list of fugitives</a> charged with environmental crimes, including:</p>
<ul>
<li>Installing a pipe behind a corporation in order to dump pollutants into a tributary of the Mississippi River. </li>
<li>Illegally dumping tons of oil-contaminated grain from a ship into the ocean.</li>
<li>Smuggling 105 thirty-pound cylinders of ozone depleting contraband.</li>
</ul>
<p>Now, which is more worthy of receiving the “eco-terrorism” label? Crimes that indiscriminately put humans, animals and the environment at risk, for personal profit? Or narrowly-targeted actions (not all of which are even criminal) intended to stop environmental destruction? </p>
<p>Who do you think is the &#8220;eco-terrorist&#8221;: The <a href="http://www.greenisthenewred.com/blog/ucsc-ninjas/337/">tree sitter </a>or <a href="http://www.commondreams.org/headlines01/0725-01.htm">Boise Cascade</a>? The Earth Liberation Front or Monsanto? <a href="http://www.greenisthenewred.com/blog/utah-bill-would-make-tim-dechristopher-eco-terrorist/1034/">Tim DeChristopher </a>or mining corporations? Earth First or General Motors? </p>
<p>We will never see the government use that term against people who pollute the environment, though. Why? Because environmental destruction doesn&#8217;t threaten political or corporate interests. </p>

</div>Before Marie Mason ever set foot in the courtroom, before the ink on her indictment had even dried, <a href="http://www.greenisthenewred.com/blog/2008/03/11/michigan-arrests/">the government was smearing her as a &#8220;terrorist.&#8221; </a></p>
<p>At a press conference announcing her arrest, an FBI agent said &#8220;domestic terrorism is a top priority of the FBI.&#8221; A police chief called the 1999 Earth Liberation Front arson at the Michigan State University campus, targeting genetic-engineering research, a “significant act of domestic terrorism,” though no one had been injured. And taking things even further, MSU President Simon argued that these “terrorists” were attacking freedom itself. </p>
<p>As a mother of two and a longtime community organizer, Mason had a lot to lose. Still, she stood her ground. </p>
<p>Soon, news broke that her former husband, Frank Ambrose, had worn a wire to entrap his friends and spy on lawful environmental gatherings<span id="more-993"></span>. </p>
<p>Ambrose had made the mistake of throwing away personal records in a dumpster. <a href='http://www.greenisthenewred.com/blog/wp-content/Images/ambrose_mason_detroit_subpoena.pdf'>According to a search warrant</a>, a dumpster-diver found boxes that contained Earth First! magazines, maps of Michigan with the location of an ELF attack highlighted, an M-80 explosive device, a block of candle wax, and even a gas mask labeled &#8220;Frank&#8217;s Gas Mask.&#8221; </p>
<p>The dumpster-diver called the cops. In <a href="http://www.mlive.com/news/ann-arbor/index.ssf/2008/09/investigators_waited_four_year.html">the words of a retired FBI agent </a>who was involved in the case, &#8220;There&#8217;s no question that the discovery in the dumpster was the catalyst that caused this thing to move forward.&#8221;</p>
<p>The FBI easily traced the materials to Ambrose, and promised to soften his punishment if he cooperated. According to the government, <a href="http://www.usatoday.com/news/nation/2008-10-10-841975904_x.htm">Ambrose went above and beyond what was expected by the FBI</a>. His cooperation &#8220;has been nothing short of remarkable, both in terms of the time and effort he put into it and in terms of its value to federal law enforcement,&#8221; said Assistant U.S. Attorney Hagen Frank.</p>
<p>He recorded 178 conversations with a variety of &#8220;targets,&#8221; traveling out of state seven times.  The government credits him with bringing &#8220;long-stymied eco-terror investigations back to life.&#8221; After turning on his former wife, and violating the trust and confidence of untold numbers of activists, <a href="http://www.usatoday.com/news/nation/2008-10-20-michigan-arson_N.htm">Ambrose would have his sentence reduced to nine years in prison</a>. </p>
<p>Still, Mason stood her ground. The government offered her 15-20 years in prison if she agreed to name names; otherwise, prosecutors said they would push for life in prison. Mason said she would accept a <a href="http://www.greenisthenewred.com/blog/2006/10/07/backfire-plea-bargains/">non-cooperating plea agreement similar to those in the Operation Backfire cases</a>, but she refused to become a government informant. </p>
<p>It looked like the case would head to trial. And then, just two hours before the deadline for the agreement expired, the government relented and offered a new deal. Mason would have to name Frank Ambrose (who had already named himself and become an informant) but she would not have to provide any additional testimony or debriefings. </p>
<p>&#8220;Because of the cooperation of her former husband Ambrose, there is no expectation that Mason would win a jury trial,&#8221; <a href="http://freemarie.org/">Marie Mason&#8217;s support committee said</a>.  &#8220;Part of this decision is also the long sentences handed to the very few <a href="http://www.greenisthenewred.com/blog/green-scare">Green Scare </a>arrestees who have gone to trail, such as <a href="http://www.greenisthenewred.com/blog/2008/05/09/mcdavid-sentenced/">Eric McDavid</a>, as is the intense financial and emotional strain that this process is taking on Mason&#8217;s immediate family.&#8221;</p>
<p>The government labeled Mason&#8217;s arrest and plea a victory in the &#8220;War on Terrorism,&#8221; but they still wanted more. </p>
<p><a href="http://www.nocompromise.org/news/031031-sweetwater.html">Mason had a history of resisting government intimidation</a>. In 2002, she and Ambrose fought a grand jury subpoena investigating sabotage at an Ice Mountain water bottling plant. In an ominous message at that time, Ambrose told <em>No Compromise</em>: &#8220;The FBI’s unwelcome visits are meant to serve as a distraction and a deterrent to citizens’ ability to express their discontent with government policies. They want people to be afraid to get involved, for fear of being harassed by the FBI.&#8221;</p>
<p>Ambrose would later turn his back on such convictions. But Mason refused, and that didn&#8217;t sit well with the government.</p>
<p>In court filings, prosecutors argued that Mason&#8217;s refusal to cooperate has elevated her <a href="http://www.mlive.com/newsflash/michigan/index.ssf?/base/news-62/123341724396710.xml&#038;storylist=newsmichigan">&#8220;to the status of movement heroine&#8221;</a> among environmentalists. </p>
<p>That&#8217;s a striking insight into one of the reasons environmentalists and animal rights activists are labeled the &#8220;number one domestic terrorism threat.&#8221; Why is it such a government concern that, as one prosecutor said, &#8220;She has become a figure of admiration to that community&#8221;? </p>
<p>Because when people refuse to buy into the scare-mongering, when they refuse to name names even at great personal cost, when they take principled stands even as the full weight of the government is bearing down upon them, it shakes the very foundations of the &#8220;Green Scare.&#8221; It challenges the power of fear, and sends a message that others can do the same. </p>
