Josh Fox, the director of the Academy Award-nominated documentary Gasland, was arrested by Capitol Hill police.

Josh Fox, the director of the Academy Award-nominated documentary Gasland, was arrested by Capitol Hill police today as he and his crew of journalists attempted to film a public hearing on a controversial natural gas issue.

House Republican leadership directed Capitol Hill police to detain the film crew. Approximately 16 officers entered the room. Apparently there were objections to Fox and the crew not having proper credentials (which, if given the opportunity, could have been easily obtained).

Zach Carter at Huffington Post has a detailed account, which he has been updating. (Politico also has decent coverage.)

I have received dozens of tweets and emails about this (and the Huffington Post article in particular) and I would like to caution readers against attributing these events to any conspiratorial efforts at keeping the hearing secret. Fracking is a nasty practice that involves nasty corporate interests, and Homeland Security has been spying on screenings of Gasland, but I don’t think that’s why this happened. I don’t suspect this is about being pro-fracking or anti-environmentalist.

I think the reality is far less sexy: politicians like to think they have a monopoly on power, and don’t like that power challenged.

In other words, they behaved irrationally because they are bullies and thugs. I don’t mean that as mere name calling. Events like this need to be understood in the context of the bigger assault on journalists. (Something I had personal experiences with recently).

There’s a reason that the United States fell 27 places to #47 in Reporters Without Borders’ Press Freedom Index.

I doubt this will deter Fox and his crew. But maybe it will bump up sales of the Gasland DVD?

UPDATE: Mat McDermott at Treehugger raises similar points in his great post.

At a court date last week, their charges were increased to include two class D felonies in addition to two misdemeanors.

Police allege that Marshall and Vanorden used bolt cutters to cut several holes in a fence at the mink farm, and that a vehicle near the property had hiking maps and a police scanner.

As former Animal Liberation Front prisoner Peter Young noted, the same fur farm was raided by underground animal rights activists in 1997, and approximately 5,000 mink and more than 100 silver foxes were freed.

It’s not clear yet if the two will face Animal Enterprise Terrorism Act charges. However, with recent raids in Jewell, Iowa (freeing 1,500 mink), Washington State (freeing 1,000 mink) and Oregon (freeing 300 mink), industry groups like the Fur Commission have been making the media rounds calling this crimes “terrorism.”

Kellie Marshall and Victor Vandoren are facing about 10 years in prison and are being held in county jail on bond. You can write them a letter or make a donation to their legal support at http://supportkellieandvictor.blogspot.com.

Twelve animal rights and environmental activists have been arrested in Spain and are being labeled “eco-terrorists.” Little information is available about this developing story right now, but some of the activists have worked with Igualdad Animal on open rescues, walking into factory farms where animals were being abused, documenting the animal welfare violations, and then rescuing some of the animals.

Some news outlets are reporting that the activists are alleged to have ties to the Animal Liberation Front. However, Javier Moreno, a spokesperson for the above-ground group Igualdad Animal (and one of those arrested), says his group has been targeted because the government hasn’t been able to actually catch the people committing ALF crimes. He called the attack on Igualdad Animal and Equanimal open-rescue activists “an attempt to criminalize animal rights movement” and said the eco-terrorism rhetoric is part of a continued campaign against all aspects of the animal rights movement.

“As they have no one to charge for the release of Minks, they have arrested several members Equanimal and Animal Equality in an attempt to criminalize the animal rights movement, as happens in other European countries,” he said. “The lobbies of animal exploitation and the powerful multinationals want to stop the animal movement and the repression is now coming to Spain.”

The sweeping arrests, accusing people of both above-ground and underground tactics, seem quite similar to the recent attacks on Austrian animal rights activists as “terrorists.” However, it is far too early to know.

Here is a video documenting an example of the tactic that is being called “eco-terrorism” by industry groups, both in the United States and internationally.

UPDATE: No prisoner support page yet, but you can donate to their legal support here (in English)

UPDATE 2: Official statement from Animal Equality. The Spanish government is saying the arrests are related to the recent release of mink from fur farms. Above-ground activists respond:

These two organisations, which define their activism as being non-violent, dedicate their efforts to raising public awareness of animal rights, by informing society of the consequences of the consumption of animal products and the promotion of alternatives. On the other hand, even though the organisations were not involved in the mink liberations, neither condemns these types of actions, to the extent that they defend the interests of all animals regardless of species, as none of the minks exploited by the fur industry deserves to live and die on a Spanish fur farm….

The animal exploitation lobbies and powerful multinationals wish to put the brakes on the animal rights movement in Spain, and now we are seeing the arrival of repression.

UPDATE 3: International day of protest and solidarity called for FRIDAY, JUNE 24th, 2011. Here’s a list of Spanish embassies.

As a follow up to David Pellow’s guest post, “My Student is a Sociologist, Not a Terrorist,” here is an update from his grad student facing terrorism charges, Scott DeMuth.

DeMuth has been indicted for conspiracy to commit “animal enterprise terrorism” in relation to the unsolved Animal Liberation Front raid at the University of Iowa. The government has argued that DeMuth is an anarchist, and “therefore, he is a domestic terrorist.”

This is an excerpt from a public statement by DeMuth:

…I believe I was targeted by this grand jury because of my involvement in doing prisoner support as a part of EWOK! (Earth Warriors are OK!). Further, as a part of my academic career, I have been involved in researching the animal rights and environmental movements and interviewing participants of those movements. The identity and contents of interviews are protected by confidentiality agreements, and I have an obligation to this confidentiality as outlined by the Institutional Review Board and American Sociological Association guidelines.

Because of the grand jury’s use in investigating social movements, I refused to cooperate and testify in the proceedings. Additionally, because grand jury proceedings are held in secret, there is no real way to verify if I had only given my name or if I had given away the identity and contents of each interview I have done. Therefore, if for no other reason, I believed that my participation would violate the trust and confidentiality of those who I have interviewed. I went to Davenport on November 17th, knowing that I could be jailed for contempt of court, and I was willing to deal with whatever legal consequences came with that decision.

As expected, I was jailed for contempt of court. However, two days later, I was unexpectedly charged with “conspiracy with unknown persons” under the Animal Enterprise Terrorism Act (AETA). As evidenced by the vagueness of the charge and its filing a day before the statute of limitations expired, I believe that this charge is being used punitively against me because of my non-cooperation with the grand jury. Additionally, it seems that this charge is a last-ditch effort by the prosecution eager to get a conviction in a failed investigation…

Under the AETA (and its predecessor the AEPA), the ever-expanding definition of terrorism has included everything from the ALF to PETA, even going as far as charging people who chalk on sidewalks as “terrorists.” Regardless of the many laws that exist to charge illegal activities, laws such as the AETA are written specifically to charge political ideologies and those who support them.

But this expanding definition of terrorism does not just affect animal rights activists, to which my case should attest. The government makes broad and dangerous generalizations across the board, conflating ideologies from all sides of the political spectrum with terrorism (e.g. anti-abortion activists, gun-rights advocates, environmentalists, and anarchists). Not only does the government target political activity, but it also uses the guise of the “war on terror” to target entire communities based on religion, ethnicity, national origin, and immigrant status. We must ask ourselves, “Who will be next?”

It is not just animal rights activists and anarchists who have a stake in this case, in the abolition of the AETA, and in the overall “terrorizing” of political dissent, but everyone who lives within America, everyone who values our inalienable rights and liberties, and everyone who seeks a better way of living than the one we have been given.

Justin Solondz, an environmental activist who was wanted by the FBI for “eco-terrorism” charges tied to the Earth Liberation Front, has been sentenced to 3 years in a Chinese prison for manufacturing drugs. Back in June I reported on his arrest via Twitter, and now much more details have emerged about his life overseas and his sentencing.

The New York Times reports:

The story of Mr. Solondz’s life on the lam spanned three continents, involved at least two aliases and ended in a smoky bar in one of the world’s most authoritarian countries…

According to his father, Paul Solondz, the Dali police said they discovered 33 pounds of marijuana buried in the courtyard of the house that the younger Mr. Solondz rented, as well as what the prosecutor described as a drug laboratory inside the house.

Friends of Mr. Solondz in Dali said he went by the name Isaac Cox and was a familiar figure who favored black clothing, had a dog and rode a bicycle through the stone streets of Dali’s old section. (His mother, however, said court documents said he used the name David Isaac Hart.)

“He looked like a man on the run,” said a man who knew Mr. Solondz and did not give his name for fear of retribution from authorities and fellow foreigners. “Everyone who comes to this town is running away from something, some more than others.”

After serving his prison time in China, Solondz will be extradited to the United States where faces charges for his alleged involvement in the ELF arson of a horticulture center at the University of Washington in 2001.

As his father told the Times:

“Compared to those horrible people who want to kill as many people as possible in the name of religion, the avowed mission of this organization is to not harm any people or animals,” he said. “This should not even be called terrorism.”

Scott DeMuth, a Minneapolis activist, has been indicted for conspiracy to violate the Animal Enterprise Terrorism Act, apparently in relation to a 2004 Animal Liberation Front raid at the University of Iowa. He faces up to 5 years in prison. His indictment marks a continued expansion of the scope of the new terrorism law, which has already been used to target activists who release mink from fur farms, and the AETA4, who are accused of protesting and chalking on public sidewalks.

The indictment comes after DeMuth and another local activist, Carrie Feldman, were found to be in contempt of court refusing to cooperate with a federal grand jury investigated that ALF burglary and vandalism. They were handcuffed and taken to jail for refusing to testify about their political beliefs and political associations.

I have written previously about Feldman’s refusal, and her statement to the grand jury (Activist to Iowa Grand Jury: “We will not be intimidated. We will not cooperate.”).

In a statement prepared prior to the grand jury hearing, DeMuth said:

“Grand juries can be very disempowering for us all, and especially for those targeted by them. We face questioning without legal counsel present or a right to remain silent. We can be threatened, coerced, and jailed. However, no punishment could be worse than surrendering our values. “

There has been some speculation about what, exactly, DeMuth’s conspiracy charges entail. Is the indictment for conspiracy to damage property? Or is it for conspiracy to instill a “reasonable fear”?

The truth: neither.

Bear with me for a moment. The indictment lists sections 43(a) and 43(b)(2) of the Animal Enterprise Terrorism Act, and says the conspiracy was to commit economic damage in the amount exceeding $10,000. Section 43(a) is simply the offense section. Section 43(b)(2) spells out penalties for damages exceeding $10,000. The indictment does not specify whether the charges are for violating
43(a)(2)(A) (damaging property) or 43(a)(2)(B) (instilling fear). Does that make sense? I know it’s a little tedious, but I think it’s important to clear up. (I just spoke with Matthew Strugar, who was quoted on Peter Young’s blog, and he agreed.)

Local press has been speculating. But regardless of what, specifically, DeMuth is charged with conspiring to do, one thing is clear: conspiracy charges have been used throughout U.S. history as a catch-all when prosecutors can’t get anything else to stick. That’s exactly what happened in the case of the SHAC 7, under the previous version of the Animal Enterprise Terrorism Act.

I have personally met both Scott DeMuth and Carrie Feldman, on multiple occasions. They were involved in organizing a Green Scare speaking event in Minneapolis. They are both incredibly kind, passionate, activists who are involved in a variety of local issues, including organizing public lectures and supporting the RNC 8. They are lawful, above-ground activists who have organized against the Green Scare. Now they, themselves, have become targets, and they need your support.

You can write letters to Carrie Feldman and Scott DeMuth, and email them to: davenportgrandjury@riseup.net. You can also donate to their legal support at http://davenportgrandjury.wordpress.com/
After being repeatedly exposed for serious, systemic animal cruelty, and now facing a media nightmare, animal agriculture corporations are firing back by calling for the prosecution of undercover activists who expose the abuses.

The Animal Agriculture Alliance says:

As these videos achieve the publicity sought by the groups, the Alliance is concerned that the activist employees providing the tapes are not held accountable for their failure to follow company animal care policies and their failure to immediately report mistreatment to the farm owners or managers.

There have been a slew of investigations in the last several years that have gained international attention. Two recent examples include the Mercy For Animals investigation of an egg hatchery and the Peta investigation of cows at Land O’ Lakes supplier facility.

Rather than stepping up and addressing these abuses, the industry is now arguing that it is the activists who should be punished for bringing them to light.

When I testified before Congress about the Animal Enterprise Terrorism Act, one of the concerns I raised is that the vague and overly broad law could be used to target whistleblowers and undercover investigators as “terrorists” for causing a loss of profits.

Those concerns were dismissed, just as lawmakers dismissed my concerns that the law would be used to target First Amendment activity (concerns that have unfortunately been proven true with the case of the AETA 4).

These investigations pose a serious, continued threat to the animal agriculture industry. The writing is on the wall, and they know it. They need to do everything in their power to make sure that people are not exposed to the realities of factory farms, even if that means utterly absurd campaigns like this one to arrest the activists who expose abuses.

Make no mistake: if these investigations continue, and they will, these corporations will escalate their tactics by campaigning for the Animal Enterprise Terrorism Act to be used against them.

Two activists have been arrested for using Twitter to communicate during the G20 protests, another step in the continued, escalating attack on First Amendment rights in the name of combating “extremism” and “terrorism.”

Elliot Madison is a social worker and anarchist who was arrested in Pittsburgh on Sept. 24 and “charged with hindering apprehension or prosecution, criminal use of a communication facility and possession of instruments of crime.” In plain English: police say he used Twitter to spread information about police movements during the G20 protests in order to help activists avoid arrest.

Madison worked with a group called the Tin Can Communications Collective to help activists communicate during the G20, creating a decentralized version of Twitter. Journalists from around the world, including CNN, subscribed to the service and viewed the messages posted. Madison told Democracy Now: “We put on the—about different trainings. There was a Know Your Rights training. We talked about the—there were messages I received about the raid on the Just Seeds food bus. There was information about where meet-ups were for different marches, like the students’ march. To be honest, I didn’t see most of the messages, because I was arrested very early on Thursday.”

The message in question that apparently led to the arrest was an announcement that said that the police had issued an order to disperse. The police allege that the message was intended to hinder arrests and prosecution (by that logic, the police making the announcement to arrest would also be an example of hindering arrests and prosecution).

Madison’s home was raided, and police took, among other things, Curious George stuffed animals and a needlepoint made by his wife’s grandmother of Lenin.

To put this in context, police have used sonic weapons during the G20 protests, they have beat and tear-gassed protesters and students and random people, they demanded that crowds of non-protesting passersby disperse or be attacked. These are many of the same tactics used during the DNC and RNC protests. [In this political context I, as a journalist, would sure as hell love to know where the police are, if nothing else so I don't get beaten.]

Of course, the government is spinning the Twitter usage as a demon tool of anarchist organizers to incite violence. [Just as books are a demon tool of anarchists to, well, educate themselves]. We see this time and again at these mass protests–police beat random people in the streets while simultaneously trying to pick off certain individuals as “leaders.” During the RNC protests, organizers were arrested, demonized as “anarchists,” and hit with terrorism charges for spearheading local organizing with a wide-ranging coalition.

I ran across this article from last year, sent by a reader, about a U.S. Army intelligence report warning that terrorists may be using Twitter. An excerpt from the report:

“Twitter has also become a social activism tool for socialists, human rights groups, communists, vegetarians, anarchists, religious communities, atheists, political enthusiasts, hacktivists and others to communicate with each other and to send messages to broader audiences,” the report said.

It goes on to say, “Extremist and terrorist use of Twitter could evolve over time to reflect tactics that are already evolving in use by hacktivists and activists…”

It would be laughable if it weren’t so prescient.

As Madison told Democracy Now:

“We’re not—we’re not the first. We’re the first in this country. During the Twitter revolution going on in Iran, in Moldova, in Guatemala, in the earlier newscast about Honduras, in all those cases, repressive governments have arrested folks for using Twitter. The only difference is, in all those cases the State Department, the US State Department, has condemned the arrest of these Twitter activists and had gone so far in the Iranian situation, the State Department, according to an article, asked Twitter to postpone its regular maintenance so as not to interfere with Iranian protesters to be able to send out their tweets. So the only difference is we’re the first arrested here.”

I’ve been wary of Twitter, but I’m slowly growing to love it. Sign up to follow me on Twitter and try it out. Because if the government is concerned about activists using Twitter… well, I think that’s reason enough to give it a shot.

An environmental activist has been arrested in connection with the 2006 attempted arson of homes under construction in Pasadena, California. The government says the action is connected to the Earth Liberation Front.

The FBI alleges that DNA found on cigarettes left at the scene (as part of the incendiary device) matched the DNA of Stephen James Murphy, 43. The FBI says Murphy’s DNA was in a state database for a previous arrest.

The Sept. 19, 2006, incident was unsuccessful, the incendiary device failed to ignite, but the next day “workers at the site could not start a tractor, where a note had been written in permanent marker that read ‘ANOTHER TRACTOR DECOMMISSIONED BY THE E.L.F.’”

I just talked to Murphy’s girlfriend, who said, “Steve is one of the kindest and gentlest souls I have ever met. He would never harm a fly let alone jepordize harming people, animals, or the environment. Not only was he an animal rights activists but he also did humanitarian aid and human rights work. Steve was a friend to everyone in need. Always.”

I’ll keep you posted as more comes out about this case and Stephen Murphy. But here’s something to think about: this is a three-year-old crime that wasn’t successful, didn’t harm anyone, and only involved some vandalism to a tractor. One tractor. And this guy has been extradicted from Texas, and the FBI and prosecutors are moving forward with charges against him (of course it’s too early to say, but given the history of similar ELF cases, a terrorism enhancement penalty could come into play).

Meanwhile, prosecutors don’t have money for DNA testing in death penalty cases. But they can do it for a tractor.

Police in Pittsburgh have been rolling out their new toys and dressing up like stormtroopers at the G20 protests. (Much more at Pittsburgh Indymedia). There have been reports of direct action in the streets, with activists rolling dumpsters into the paths of oncoming riot police and police pepper-spraying, beating, arresting, and surveilling activists. The Pittsburgh Tribune-Review reports police following activists in unmarked cars, but that’s clearly not the full scope of what is going on right now in Pittsburgh.

Check out this video of two men in military fatigues grabbing an activist out of the crowd, throwing him into an unmarked car, and driving on through the lines of riot police.

I’ve reported previously on local police buying tanks, and an influx of “anti-terrorism” money being used to militarize local police departments. And in the RNC 8 case, police and attorneys used “anti-terrorism” resources and rhetoric to target protest organizers. It should be strikingly, undeniably clear by now that the lines between police and military have been completely eroded. The police have been militarized, the military is policing.

There is a reason police and military operations are separated. It’s the same reason that the foreign intelligence operations of the CIA are kept separate from the domestic intelligence operations of the FBI: Even if you believe that the tactics, violence, and black ops used abroad are justifiable, they have no place at home. They are incompatible with any semblance of a democracy.
